Terms of service
Last updated: [publication date]
The agreement
These terms are an agreement between you and FaZe Media, Inc. d/b/a HardScope ("HardScope", "we", "us"), which operates SocialScope. By connecting an account or signing in through SocialScope, you agree to these terms and to our privacy policy. If you don't agree, don't use SocialScope. These terms include an agreement to resolve disputes by individual arbitration, described under Disputes and governing law.
What SocialScope does
SocialScope lets you connect your YouTube, TikTok or Instagram account to a partner app you choose, with read-only access to your profile, public posts and post counts. Some partner apps also use it to let you sign in with Google. SocialScope never posts, edits or deletes anything on your accounts.
YouTube Terms of Service
SocialScope uses YouTube API Services. When you connect a YouTube channel through SocialScope, you agree to be bound by the YouTube Terms of Service. Google's handling of your data is covered by the Google Privacy Policy.
Other platforms
TikTok's and Instagram's own terms keep applying to your accounts there. Nothing in these terms changes them, and each platform decides what it shares with apps.
Your accounts
Only connect accounts you own or are allowed to manage. You're responsible for the accounts you connect and for keeping your platform logins secure. You must be at least 13 and meet each platform's minimum age.
Acceptable use
When you use SocialScope, you agree not to:
- Connect an account that isn't yours or that you aren't allowed to manage.
- Try to reach data from accounts or apps that aren't yours.
- Interfere with SocialScope, overload it, probe its security or get around its limits.
- Use SocialScope to break a platform's rules or the law.
- Copy, resell or reverse engineer SocialScope, except where the law allows it.
We may suspend or end access that breaks these terms. You agree to cover HardScope's reasonable losses and costs, including legal fees, that come from your breach of these terms or misuse of SocialScope.
Partner apps
Partner apps are separate services. When you connect an account, you choose to share its data with that app, and the app's own terms and privacy policy cover what it does with that data. Anything a partner app offers you is between you and that app.
SocialScope itself doesn't offer payments or rewards of any kind. Counts shown through SocialScope tell you how your posts are doing.
Legal review: Confirm what partner apps' own terms say about their programmes before adding any sentence about them here.Disconnecting and ending
You can stop using SocialScope at any time. Disconnect your account in the partner app, or remove SocialScope in your platform settings. The data deletion page explains how.
We may suspend or stop a connection, or SocialScope as a whole, when it's needed for security or legal reasons, when a platform requires it, or if we stop offering the service. We aren't responsible for delays or failures caused by events beyond our reasonable control, such as outages at a platform or internet provider.
Changes
We may change SocialScope and these terms. We'll post changes on this page and update the date at the top. If a change is significant, we'll give notice before it takes effect.
Disclaimers and liability
SocialScope is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including warranties of title, non-infringement, merchantability and fitness for a particular purpose. We don't promise that SocialScope will be uninterrupted, secure or error-free, or that the data a platform shares is accurate or complete.
To the extent the law allows, HardScope and its affiliates, employees, agents, service providers and licensors aren't liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, arising from your use of or inability to use SocialScope. Where the law requires us to pay damages, our total liability is limited to the amount, if any, you paid us for SocialScope in the 12 months before the claim.
To the extent the law allows, any claim about SocialScope or these terms must be brought within one year of the events that gave rise to it.
Disputes and governing law
Before starting a formal dispute, email legal@hardscope.com with "Dispute Notice" in the subject, your name and contact details, what happened and what you're asking for. We'll each try in good faith to resolve it. If we can't within 60 days, we'll try mediation before either of us starts arbitration.
If mediation doesn't resolve it, the dispute goes to binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and the Federal Arbitration Act governs this agreement to arbitrate. You can bring an individual claim in small claims court instead if it qualifies there. You and HardScope each give up the right to a jury trial and to take part in a class action or class arbitration. Claims about intellectual property infringement aren't covered by this section.
You can opt out of arbitration by writing to legal@hardscope.com within 30 days of first using SocialScope, with your name, mailing address and your request to opt out. The rest of these terms still apply.
[Legal to confirm which state's law governs these terms.]
Legal review: FanHub's terms refer to a choice-of-law provision but don't name a state. Write the governing-law sentence here before publishing, and confirm whether the arbitration terms above should match FanHub's in full.Contact
